Tempo may, but should not, at its sole discretion, change, improve or modify hosted services. All fixes, updates, updates, modifications and new versions of hosted services (together “improvements”) made available to Tempo`s Customer are considered “hosted services” subject to the provisions of this Agreement; provided that Tempo may, at its sole discretion, authorize all improvements (including, but not limited to, a new version of Hosted Services), on separate, different or additional conditions (including an additional fee). “Built by Zendesk Marketplace Applications” refers to integrations and applications created or developed by Zendesk or its related companies and made available in the Zendesk Marketplace (available at www.zendesk.com/apps) and which are governed by this Contract, unless Zendesk provides you with another agreement at the time of your availability or access to integration or application. 7.4.1 Zendesk`s DPA can be executed here: www.zendesk.com/company/data-processing-form/. After the execution by the Subscriber, the SERVICE PROTECTION Authority is included in the terms and conditions of this agreement by reference. If you make contributions (defined below) to Zendesk Support SDK, you grant Zendesk a free, global, transferable, irrevocable, irrevocable and unlimited license that they integrate into the Zendesk service or API or use and use commercially. “contribution” refers to all works of authorship, including any modification or addition of the mobile SDK or works derived from it that will be submitted to Zendesk by you. Each of us retains all rights, titles and interests on and on all our patents, inventions, copyrights, trademarks, domain names, trade secrets, know-how and any other intellectual property rights (all intellectual property rights). The rights granted to you, to agents and end-users, for the use of the Service in accordance with these Terms, do not confer additional rights on the service or on the intellectual property rights associated with it. Subject to limited rights to access and use of the Service, including expressly, all rights, titles and interests on and on the service, as well as all physical, software and other elements of the Service, including all related intellectual property rights, remain with Zendesk and are exclusively owned by Zendesk. Zendesk has a free, global, transferable, irrevocable, irrevocable and unlimited license to receive suggestions, requests for improvement, recommendations or other comments from you, agents or end-users in the Service. Zendesk® and other Zendesk product and service names, as well as logos used or displayed on the service, are registered or not trademarked trademarks of Zendesk (all trademarks), and you can only use these marks to identify yourself as subscribers; assuming that you are not trying to assert trademark rights now or in the future, alter the distinctiveness of trademarks or use trademarks to misrepresent or misrepresent Zendesk, its services or products.
